Terms & Conditions Beyond Limits Productions (BLP) Is dedicated to providing the best service possible to you (The Client.) To keep up with demands, BLP must implement a variety of agreements to protect all parties�¢?? interests. BLP strives to be upfront and to always communicate all necessary information as needed.
Privacy Policy: BLP will not intentionally sell your information to third party companies. BLP's contracted service providers may have access to the clients name, phone number and listed property address as needed to complete the commission services.
Clients must submit a written request at the time of the order, notifying BLP of their intention to keep the media private. BLP respects our clients desire for privacy and will not share media that a client requests to keep unpublished when applicable.
Rights: Under current copyright laws, ownership of all media belongs entirely to Beyond Limits Productions.
BLP retains all rights to media taken of properties unless otherwise agreed upon in writing, and only licenses the use of the images to the Listing Agent ("CLIENT") of the property for marketing purposes while the listing is active (up to one year). All images produced for the client may be used by the client for any and all marketing materials and campaigns associated with the property and for the client's self promotion. The media may also be used by the client's parent company for the sole purpose of marketing the specific property photographed. Any usage of the images by a third party, including but not limited to, architects, builders, stagers, designers, sellers or buyers, is strictly prohibited unless approved in writing by BLP.
Media created for clients may be published on BLP''s social media and other platforms for the purpose of marketing and advertising.
Relationship of the Parties:
BLP is an independent contractor, and shall not be deemed to be an employee of the client. No agency, partnership, joint venture, or employee--employer relationship is intended or created by this agreement. Neither party is authorized to act as agent or bind the other party except as expressly stated in this agreement. BLP and the media or any other deliverables prepared by BLP shall not be deemed a work for hire as defined under Copyright Law. All rights granted to client are contractual in nature and are expressly defined by this agreement.
Payments/Fees: The client is agreeing to pay for the services provided by BLP. All services completed must be paid for before BLP can deliver media to the client.
A client's decision to not utilize media provided by BLP does not remove the requirement of payment for completed services. I.e. the client decides not to sell their property and no longer has use for the media.
Invoices must be completed within 5 Business Days of the appointment completion.
Refunds: The client agrees to accept the style and presentation of media as it is consistent with what is available in BLP's online media galleries and portfolio. BLP strongly encourages the client to review the social media accounts and website of BLP to assure that the presented style of images and other media is agreeable to the client's needs.
Media consistency may vary based on several factors. Lighting, time of day, weather, surface colors and materials may affect the final media results.
BLP will refund the client's paid invoices for commissioned services if the appointment is cancelled more than 24 hours before the scheduled appointment time.
Services utilizing third party software may be subject to outages and unforeseeable delays. BLP may provide refunds or alternative services in the event that a third party software provider does not perform as expected.
Scheduling/Cancellations/Rescheduling: The Client is responsible for providing a correct property address. BLP is not responsible for confirming the correct address. If BLP or it's service providers arrive at the incorrect address, the penalties lie with the client. Services performed will still be charged. I.e. Aerial Photography shot of a vacant property with no agent available to confirm the correct house.
The Square Feet measurement included on the order form must reflect the total area of the property that will be photographed, video recorded and/or scanned. Should the measurements be incorrect, the final invoice price may be adjusted by BLP to reflect an accurate measurement and services provided.
Some services may not be able to be completed due to weather or property conditions. In the event that this may occur, BLP will attempt to make contact with the Client and notify them. A discount may be granted for incomplete services at the discretion of BLP.
Rescheduling options are available through the website and emails. Reschedule must be completed the day before the scheduled appointment time. Rescheduling or canceling appointments the day of the scheduled appointment may result in an additional fee such as last minute cancellations when BLP is already enroute to the appointment.
Appointment Condition: We reserve the right to refuse services for any reason, including property conditions or the appearance of dangers to BLP's safety.
The client is responsible for removing all cars, pets and people from the property before the arrival of BLP and their service providers.
The client must disable any security alarms and provide instructions on how to access or direct access to the property before the appointment begins.
The home must be staged by the client to their preference ahead of BLP's arrival.
BLP is not responsible for staging the property. I.e. Moving furniture, turning on lights or opening curtains.
Staging services may be provided in specific scenarios and may include additional costs.
Photographers are not responsible for the unintentional damage or destruction of items such as light fixtures, furniture, curtains and blinds, doors, garage doors or any other item BLP may attempt to stage for the appointment.
BLP is not responsible for returning the property to it's original condition at the end of the appointment.
BLP requests that the client or a representative of the client is present for beginning and ending of the appointment to ensure the property is staged how they would prefer and so they can secure the property afterwards.
Specific photos and media requests such as special angles of particular items must be submitted in the order notes. BLP will do their best to accommodate these requests but cannot guarantee the result will match the client's expectations.
Media Delivery: BLP Strives to provide photos within two business days. Video services are to be completed within three business days.
Media will be delivered within BLP's provided online software. BLP does not provide physical device delivery of media.
Media download times may vary based on media file size and the user's internet connection speed.
Media will be available for download for up to 12 months from the date of payment. After 12 months, files may still be delivered at an additional fee.
Revisions and Alterations: BLP strives to offer the best media possible. If unintended errors in the media are discovered, BLP will attempt to correct these errors as quickly as possible at no cost to the client..
BLP will not delete items by default but attempts to remove vehicles in driveways, realtor signs in yards and subject's reflections when applicable.
Additional Object remove/decluttering requests must be submitted via Email to be ordered.
Included Twilight Edited photos from the Bronze/Silver/Gold Packages will be selected and edited by our team.
Additional Twilight edit requests or Virtual Staging Requests must be submitted via email after the delivery of the original media. The specific photos must be identified by the client unless said otherwise.
Referrals and Discounts: While pricing is set firmly to support the team and families of BLP, there is potential for discounts based on volume of orders and sales.
BLP may grant or remove Referral Bonuses and Discounts at their discretion.
Clients who attempt to subvert the intent of the referral program with methods such as creating multiple accounts to award the automated referral bonus may have it withdrawn manually by BLP.
